Investors who underwrite a Santa Monica building using assumptions carried over from Los Angeles get a rude surprise, because the rules on registration, allowable increases and removing a unit from the rental market are genuinely different.
For financing, the consequence is the same one that applies anywhere rent is regulated, only more so. A lender qualifying an investment property on its income uses in-place rent, the rent the units actually produce today. On a controlled building with long-tenured tenants, that figure can sit far below anything a market survey would suggest.
So the model built on market rents and the loan built on actual rents are two different deals. The building may still be worth buying. It simply has to be financed on what it earns now, which usually means more money down than the spreadsheet assumed.
Verify status before you write the offer
- Get the current registered rents from the seller, not an estimate from the listing.
- Confirm each unit's controlled status rather than assuming the building is uniform.
- Ask about any pending or recent rent adjustment petitions.
- Check whether any unit has been removed from the rental market and what that means for re-renting it.
All of that is a few days of work and it determines whether your financing assumptions survive contact with underwriting. It is far cheaper before contingencies than after.
Condo project review, which stops more files than credit does
Santa Monica is dense with condominium property, and every condo file runs a project review alongside the review of you. Owner-occupancy ratio, reserve adequacy, delinquency rate, single-entity ownership concentration, and litigation.
Pending HOA litigation is the one that most often ends a file, and it has nothing to do with the borrower. Someone with excellent credit and substantial assets gets declined because the association is in a dispute with its builder.
Some buildings clear conventional review easily. Some need a portfolio lender who reviews the project on their own terms. Knowing which category a building falls into before you are three weeks into escrow is most of the value here, and the HOA questionnaire is where you find out.
Buying here on self-employed income
Santa Monica has a heavy concentration of people who own their income rather than receive it. Agency principals, consultants, physicians in private practice, tech founders taking distributions, people with substantial portfolios and modest taxable income.
